Registered sex offender - Level 3

Our small town local Penny saver ran a notice this week, from the police that a level 3 sex offender had moved into the zip code and that more information could be obtained through the police department.

Level 3 offenders can be looked up online, so I did. Now it turns out that this guy lives a stone’s throw from a primary school, in a small village where kids walk by going to & from school everyday.

Thing is, his victim was a 10 year old female, he was convicted of:
Sexual Abuse-1st Degree

Incarceration Sentence: 28 Month(s) to 7 Year(s), State Prison

Maximum Expiration Date/Post Release Supervision Date of Sentence:
Jan 20, 2003

Offense Description:
Actual Sexual Intercourse
Actual Deviate Sexual Intercourse
Actual Sexual Contact
Relationship to victim: Non-Stranger - Otherwise Known
Weapon used:
No weapon used
Force used:
Threat

Pornography involved: No

This information is the same as what is on the NYS DOC inmate locator for this person also.

From what I understand, other than being made to register as a sex offender this person is under no supervision as far as probation/parole goes.

Defining a Level 3 offender:

Level 3 - If the risk of repeat offense is high and there exists a threat to the public safety, a level three designation shall be given to such sex offender.

I guess my question is…is he allowed to live that close to a school?
I’m also guessing that since he is – the answer is yes, since he is not under any supervision that would restrict him from doing so.

I just thought that all sex offenders couldn’t live near a school.

Can they?

A cursory review of the requirements doesn't show a restriction, other than notice to the school of the presence. However, you might want to check with the authorized agency.

If the sex offender is not on parole there are no other rules he has to follow except letting the police department know where he lives and telling any employer that he is a registered sex offender. Other than those two things a sex offender can go and do whatever he wants and live wherever he wants.

In Florida, a convictd sex offender can not reside within 1000 feet of a school. Some offenders are not to be near, or left alone with, minors or children under a certain age.

Some things to consider:

There's probably a sex offender in every neighborhood.

Most sex offenders are never caught or judged guilty in a court of law. Studies abound with estimates of 100-200 children violated before one arrest by pedophiles.

Many offenders and predators plead down to lesser charges or pay off their victims.

Most sex offenses are reported to be relatives of victims and most victims violated in their own homes i.e. step-fathers on step-daughters.

Knowing who is on a sex offender registry might not keep children safe. Estimates are that 1/2 million children a year will become victims.

Children may be more likely to encounter a sex offender than a fire by age eighteen. Children need an education in how they could best protect themselves from known and trusted individuals...safety plans when they sense something is wrong. Offenders will be most likely - one of us.
