Can my employer cancel my health insurance while I was laid off, still an employee. waiting for more work.

Unless you have a contract that specifically says otherwise, yes, he can. However, within 44 days of the last day of coverage, they must offer you the chance to continue the insurance at your own expense.

Just as an addition to the above answer: COBRA needs to be offered if an employee is laid off such as what occurred here a few years back. For those we laid off temporarilly (less than 3 months) we paid for their insurance 100% but that was something the owner decided upon...we did not have to.

I am in NJ by the way.
