disclosure of drug test results

I applied for a job at a casino on an Indian reservation. They came back and told me I failed the drug test. They said all I could do is contact the testing center and pay to have further testing done to find out why i failed. I left 2 messages with them and they never returned my calls. So, I never got the job.

Found a new job and prior to being hired I told them about what happened. Just so happens that the casino is a customer of my employer. When the casino found out I would be coming out there they contacted my new employer and said I would not be allowed on the constuction site of their new facility until it was all complete and proceded to tell them about the failed test.

Isn't it illegal for them to disclose that info to anyone but me?

The Indian reservations operate under some very different rules ... in theory they have to abide by federal disclosure laws, but in all practicality, they sort of pick and choose what they must abide by.

Personally, I don't know that they did anything illegal. They have the absolute right to tell your employer that you will not be permitted at the work site. And they likely can tell them why - "He failed a drug test for us." I do not think this is in any way a protected secret.

But, to know for sure, you can speak with an attorney.

For HomeGuru -- Your only comment was are you still on drugs -- I think the person asked a question about drug test result disclosure - WHY DOES SOMEONE ALWAYS HAVE TO BE A JERK TO ANYONE ASKING QUESTIONS RELATED TO DRUG TESTING ISSUES - If your not going to answer the question and be productive keep your comments and judgements to yourself. As for disclosure of drug test results... check the laws in your state. Several states have right of disclosure laws when it comes to employment drug test issues.

I couldn't tell you how many rude responses that I have gotten from other people. Most of the time on these boards, you are waiting for an honest response, but all you get are silly responses.

This poster got the legally valid answer in the FIRST response. If you have anything other to post based on the LEGAL ASPECTS of the case, then feel free.
