We are currently having a block wall constructed. There is a drainage easement on our property, but will be building the wall to leave the easement open. We are concern about children playing in the easement, as they do and getting hurt. The easement is part of our property. Will it help our situation any if we sent letters to all the neighbors asking them to keep their children from playing in the easement; or will we still be responsible if anyone gets hurt? Is there any way we can protect ourselves, since we could not build anything on the easement to enclose it with the rest of our property?

Your letter could be used if needed to show a court that you warned the neighbor(s), but it would not waive your obigations, if any.

That depends largely on what you are trying to protect yourselves from, however, other than making sure you have sufficient insurance, not really.
