A friend of mine was recently accused of forcing a girl to go farther than she wanted sexually. This is untrue. She wanted to have intercorse but he stopped because they didnt have a condom. They're both 18.
Now she's telling everyone that she only went along with it because she felt like if she didnt he would rape her. (which you would know how rediculous this accusation was if you new my friend) And all her friends are spreading this rumor and he's getting threats and being harassed.
Can he take her to court for slander?

Voicing her opinion or intent isn't slander, now if she said he raped her when he did not that you be different. But if he were to sue for slander, what would he get, what does an 18 yo have as assets? Does your friend have a lot of money to burn on attorney fees for a case that may not yeild any settlement or judgement?

Of course he can take her to civil court. After all, anyone can sue almost anyone else over almost anything. However, he has NO chance of winning as her conduct is NOT defamation.
After all, how would he PROVE to a court that her OPINIONS ("that she only went along with it because she felt like if she didnt he would rape her") weren't true.
