Wasn't sure what forum to post this in, so....

I had a complaint filed against me some years ago but was not arrested or prosecuted. Is the complaint form/incident report a public record? Is it something that would show up in a background check?

Since there is no such thing as a cookie-cutter "background check" it is almost impossible to say whether it will show up or not. Can it? Sure. Will it? Nobody can say.

If you were arrested and booked, there is a good chance that the record will show up. If not, the chances are greatly diminished.

However, if the background check is even slightly thorough, they will talk to friends and acquaintances, and if any of them know about the arrest then it will come out.

What kind of job are you applying for? And what was the nature of the allegation? This will help in trying to sort the answers out.

There was no arrest. It was a harrassing phone calls complaint.
