Open to all/any advice.

My friend was injured while working on the roof of his brother's house. He was using a nail gun, and in what would now appear to be a "freak" accident, the nail gun discharged, and a nail went though his eye. He pulled the nail out himself and was rushed to the hospital. His question is - Can he receive compensation for his injury from his brother's home owner insurance, or any other insurance his brother may have?

He pointed the nail gun at his own eye? Was it your friend's nail gun? Other than owning the home, what negligent act did his brother do? Was your friend getting paid to do the work on the roof?
