What is the name of your state? Utah

We're building a house in a new development on a street which slopes down from north to south. The house to the north of us was built when we started building and there was a six foot slope/cliff on that side, so we had to build a rock retaining wall on the north side of the property. That cut into the space we would have liked to have for a driveway. The house to the south hasn't been built, but the property owner asks that we retain our soil. They plan to start building before we are completed (so they say). Is it true that the owners to the north didn't have to build a retaining wall because they were already in? Is it also true that we have to build the retaining wall for the neighbors to the south? And do both walls have to be on our property?

That's really a very local issue concerning the building codes for your municipality and HOA rules if any etc. I think your best bet is to bite the bullet and talk to a lawyer in your area.
