What is the name of your state? Texas

December 31st, can you have filed but the divorce not
final or can you not have yet filed to file a joint return
for the year?

We will be ready to file and the mandatory wait is 60 days in
Texas so the divorce won't be final till next year.

We want to file a joint return for '04.

If the divorce is not final you must either still filed as married or married but separate.

So yes, you CAN file a joint return if that is what you both wish to do.
