layed off for health condition

What is the name of your state? WI

My mother was layed-off and not asked to return. She is a waitress, and her employer does not offer health insurance. She does not make enough to afford individual health insurance so she is not adequately taken care of. We believe she has asthma or bronchitis, although she's never been diagnosed.
Is it against the law to lay-off/"fire" her because they perceive her to be too sick? Also, what are her resources for income assistance while looking for a new job, unemployment, disability, etc.?

Are you saying your mother was laid off/fired solely because she and her employer suspected she has a respiratory ailment? Or was she fired because she was absent frequently and/or had difficulty performing her job duties?

Yes, she was layed off because she has a respiratory ailment. She is able to work, and she never misses work.

That MAY be illegal. However, since she works in the food service industry it is POSSIBLE (not likely, but possible) that public health concerns are involved.

Bottom line: she is free to contact the EEOC and see if they believe she has a case.
