Horseplay gone bad

Hello. We were at a banquet hall for a youth organization. My 13-year old son and a man in his 30s or 40s (who was extremely drunk) were horseplaying. At one point, my son tripped and the man drug him across the floor. When my son told him to stop because he was getting a rug burn, the man would not stop so my son grabbed the man's foot and tripped him. My son and the man both got up and my son pretended like he was going to jump at him. The entire time, both of them were laughing. When the man went to walk around the corner, my son turned his back to go back into the hall (thinking everything was done). The next thing my son knew he was on the floor--tackled from behind by the drunk. My son ended up with a bruise on his arm caused by the man grabbing him too hard. When the drunk was confronted by an older child (17 yrs old) and told he had too much to drink and he needed to settle down he cursed terribly until the children went to find their parents. When Dad found out he was extremely angry that the man had left marks on our son and went to confront him. When he told the drunk to never touch our son again the drunk used profanity to the point of the father trying to get to the man. The father never touched the man--as there were too many people around to stop him. (But he probably would have!) The father went outside and decided to let the police handle it--so he called them and was waiting for them outside. After 15 or so minutes, the police had still not arrived but the drunk man was being escorted from the building by a security guard. When the guard got the man to the door and the man saw the father outside waiting on the police, he tore out of his shirt from the security guard to get at the father. The father and the man ended up in a nasty fight. Luckily, the police showed within seconds of the fight and separated them. They were both put into handcuffs, but after speaking with the witnesses and security guard, the father was released with no charges. The drunk was charged with assault of a minor and assault of an adult. Here is my question finally. The drunk has now filed assault charges against the 13 year old! Should we, as parents, be concerned and hire an attorney for this? AND do the parents have a case as far as a civil case to have the drunk pay for legal fees, travel expenses, time off of work to go to court, etc?
