first time marijuana possesion

i was pulled over for supposedly running a red light that was yellow. i wasn't pulled over until the police saw my drug selling friend in the back. he proclaimed he smelt pot even though it had been an hour since we smoked and the car had aired out. as i wasn't the liscensed owner of the car (my parents) they were able to search it and found my small sack (1 or 2 grams) and said that they were charging me with possesion and a dui. how do you fight the dui as i was not intoxicated?

Simple, plead not guilty.

And, if the officer smelt marijuana, they had reasonable cause to search the vehicle regardless of who owned the car.
