private property ticket

What is the name of your state? ohio

My son was leaving a private parking lot and a police officer had his lights off...there were no lighting in the lot.. and he came close to hitting him. the officer gave him a ticket for failure of right away and noted that he put on the ticket that he was almost hit.. There was a witness about the officer having his lights off
can he get a ticket for that?

I'm curious, in what jurisdiction in Ohio did this occur?

Also, this isn't one of those "trick" posts, is it? The officer's lights were off, but it also happened to be 2:00 P.M. on a Saturday afternoon.

I've never heard of "failure of right away" as a moving violation - perhaps he should speak to a urologist if its negatively impacting his private life though.

Apparently he did get a ticket for that. His next step is to challenge it in court. He'll need to bring his friend with him and they can explain that the officer could not be seen in the dark. If the officer was not moving, then your son is likely going to take the hit because he should be watching what is in front of him. If the officer was moving, there is a good chance that he'll be able to get off ... depending on ALL the circumstances.

Remember, your boy could be giving you the sugar-coated version o fthe truth.
