Hello:

I am in quite a fix and could use some advice.

Yesterday, I started a temporary assignment through a
temp agency. I worked a full eight hour day and it
was uneventful (or so I thought).

Upon returning home last evening, I received a call
from a representative of the temp agency. She said
that I was not to return to the assignment. I asked
her for the reason, and she told me that it was
because I smelled of alcohol.

I thought this was quite strange since I haven't had a
drink (of any alcoholic beverage) since I was at a
wedding in August. Upon further questioning, I was
told that one of the empty bottles of Deer Park water
I threw in the trash can smelled of alcohol.

Does anyone out there know if impurities in the water
or in the plastic bottle could make the bottle smell
from alcohol? I spoke to the agency head this
morning. She told me that there will be forensic
testing done on the bottle in the next week or so.

I have some issues with this (chain of custody,
tampering after I put it in the trash, etc.). Also, I offered
to submit myself to any type of forensic testing requested
by the agency.

What I would like to ask of you all is this: Do I
have a leg to stand on WRT wrongful termination and a
possible suit against the agency (and possibly their
client as well)?

Thank you in advance as this is a most trying
situation.

I have no idea whether any kind of impurities could make the bottle smell like alcohol. I imagine it would depend on the impurities.

But it doesn't matter a whit.

You have no wrongful termination case against either the agency or the client company.

A great many people seem to believe that if they are fired for allegedly performing some action, and they did not in fact perform that action, that is a wrongful termination. They are mistaken, if they are referring to the legal definition of the term, wrongful termination.

A wrongful termination means that it was ILLEGAL for them to term you for the reason that they did. The law does NOT forbid them from firing you on suspicion of wrongdoing, even if they are completely mistaken.

You may have been mistakenly terminated, but you were not wrongfully terminated.

Do I have a leg to stand on WRT wrongful termination and a possible suit against the agency (and possibly their client as well)? No. Terminating you on suspicion of drinking on the job and/or bringing alcohol onto the premesis is not unlawful even if they are mistaken.
