What is the name of your state? South Dakota

Is my employer required to pay me for any earned personal and vacation days if I leave the company? If they are required and they don't pay up, what recourse do I have? Thank you in advance for any help you can give.

NO state requires the payout of personal days unless they are part of a PTO package where all paid time off regardless of reason comes out of a single time bank.

The state of South Dakota does not require the payout of vacation days on termination.

Thanks for the info, it's good to know. One other question I have is what if I work in one state, but am employed by a company in another state. Which state would dictate who's laws would apply?
