A friend of mine was married to his girlfriend years ago. They got devoice after he got the greencard. Now he wanted to get his citizenship. However, his ex- wrote to the INS and stated that that was a fake marriage. Now he is under investigation. His ex- cheated on him and did drugs while they were still married. Then he had an affair with another woman which he had a baby with. That maybe used as an evident that that was a fake marriage. (there was no proof that she cheated on him or she did drugs anymore)

What can he do to stay in US? He cannot marry another citizen because
INS will suspect that that is a fake marriage. Maybe he can marry his baby's mother but they don't get along anymore. How can he proof to the court that that wasn't a fake marriage?

Was there a divorce? If so, on what grounds? How long was he married to her? Your friend should consult with an immigration lawyer. If this ever comes to a deportation hearing, certainly one of the key issues for determination would be whether the marriage was entered into with bonafide intent.
