Conspiracy to traffic in drugs

I am writing for my sister who has been indicted for conspiracy to traffic in drugs. She was hanging out with a cocaine dealer who left his scales and some other stuff at her apartment. He was arrested outside her apartment selling to an undercover cop. He's been under investigation for some time. The police subsequently used the key to her apartment taken from him to open her door and walk in. They then surrounded her and essentially bullied her into signing permission to search her home. They found the stuff which had no drug residue on it and a small packet of coke that she had for her own use. It must not have been big enough to even bother with as they did not arrest her. However, she received a letter in the mail saying she has been indicted for conspiracy in drug trafficing.

Is this legal? Can you be indicted without ever being arrested or charged?

Oh, didn't realize that. Well, if she was not involved in any of this drug selling can a conspiracy charge stick?
