What is the name of your state? NJ
I have a situation where our 6 unit condo association voted to take us to court because we do not want to make certain amendments to the master deed.
First they want to take us to court because the backyard is a limited common element in favor of our floor. They state they were under the impression from the realtor and mls listing it was a shared yard. The deed states it in favor of our floor, (main reason we purchased the unit for the yard).
Secondly they voted for the association to take us to court to change our voting rights for an amendment, which currently they can't pass any amendment unless we vote for it because our ownership % is too high. Does the association have the rights to take us to court? How can we vote yes on a motion to take ourselves to court? What rights do we have to stop the continual legal harassment over the yard and voting rights?
