Facts: Phoenix, Arizona 10-13-99
Commercial storage lot rent is unpaid over 2 years. The Yard is used to house collector cars of 1950's, 1960's. The Landlord carrying back unpaid rent because tenant is deathly ill, and landlord says he is trying to be helpful, but also waiting because tenant has future means to pay entire past due rents. Landlord puts yardman in yard in Jan, 1999 to help sell items for tenant, allows yardman to fix up and live in mobile home and pays for his water, electricity and cell phone. Tenant is on dialysis 4 times a day, extremely ill, waiting on receipt of funds to pay off landlord. Tenant asks landlord to get rid of yardman because yardman is stealing. In September, 1999 Yardman arrested for having stolen cars, and running chop shop on tenants yard and when released from jail, landlord allows him back in yard. Landlord claims he can't make him leave yet all he has to do is turn off elect and water. Yardman has up to 5 other people living on yard. Tenant finally was well enough to go look at yard and finds most all of his classic cars are destroyed, parted out, cut up. Landlord tells any and every one that tenant is behind in rent, including potential buyers, therefor destroying tenants ability to obtain highest fair price. Landlord calls tenants competition and tells them tenant is behind on rent and asks for bids on tenants property. Buyers are influenced to make low
offers. Landlord repeatedly offers to take all cars in lieu of back rent.

Tenant feels landlord is destroying tenant, deliberately allowing tenants cars to be plundered to the point of only being worth scrap, so landlord can turn it into his own business.
Tenant needs a lawyer who will take this on and fight it. Tenant is not trying to seek undeserved money from landlord, but seeks relief for value lost. Landlord is in STRONG financial position. Tenant is permanently disabled and on fixed income.
Tenant need a court order or injunction or whatever its called to make the yardman stop tearing the cars apart, and to move out, and an action against the landlord. Have digital photos to document most of these claims.

Did you report this to the police? Is the use in compliance with zoning codes? Enviornmental laws?

Police report coming soon, after a lawyer is found. Yes, its zoning compliant. Cars were made environmentally safe before yardman got in there. No oils, no cfc's, no anti-freeze. I AM RESPONSIBLE, just deathly sick. The yardman is one of these "White Brotherhood" types, and I have valid reasons to be afraid. Im just not sure of my position. Illness is debilitating, and people take advantage of that.
