right of way, broken pipes, Who pays?

My Mom sold land behind her house in Louisiana. The right of way runs right over her septic lines. The septic pond is on the other person's land, but it's wrote in the sales agreement that she has use of the pond for as long as she lives there. The woman who bought the land moved mobile homes in for rent purposes. That is what broke the septic lines. The woman who broke the septic lines refuses to pay to have them fixed. Who is suppose to pay??

Your answer depends on state law. How much will it cost to fix the lines? What if your mom offers to split the bill with the other owner? My thoughts are these, if the cost to repair is low enough then your mom could pay for the whole thing herself and/or decide to sue for all or part of the cost. It really depends on how much money is at stake and how much hassle your mom is willing to go through. Consult with a LA real estate lawyer if you are thinking about suing to see what your rights are and how much it would cost for the lawyer to represent you.
