title insurance

Property we purchased several years ago was found to have extensive title problems when we tried to sell it. We have title insurance for the value of the property at purchase time, but the selling price was $15,000 more. Do we have recourse with the issuing attorney above the amount of the title insurance? How long should we wait for the attorney to resolve the title problem?

If you had an attorney assist you in the previous transaction and he did not learn of the title defects at that time, I think you can make a good case for malpractice and have reason to file an ethics complaint with the state bar association. Notify him/her of your concerns, give him a short time to make good on your $15K loss and if no relief is forthcoming, then hire another attorney. be sure to sue the original attorney for your attorney fees incurred on top of the the $15K loss.
