What is the name of your state?NH. My employer offers a 401K plan that they do not contribute to. We are paid every two weeks and our 401K deduction is taken out in each paycheck. Our employer holds the money, interest free, until the end of the month, then makes the contribution about 1 week into the following month. Is it legal for them to make the decution and then hold our money interest free for that period of time.

The law says they have to submit it "as soon as administratively possible" - there's no specific number of days or weeks. If you really wanted to push the issue, they would probably be found to be out of compliance as it should be possible to do it more than once a month. However, it really will depend on the exact circumstances and how hard you want to push them.

My Payroll Source book references the same "as soon as administratively practicable" or no later than 15 days following the end of the month that the contributions were deducted.
