I have been contacting several different INS offices in hopes to find someone who can point me in the right direction, but always manage to get "passed off" onto someone else. Needless to say, no one has been able to give me any answers.

I am a Canadian Citizen, my fiancé is an american citizen. We have two children together. One Born in Canada, and the other born here in the US.

Our first son, (Born in Canada) was born prematurely and has several specialists here at Children's Hospital, and I certainly wouldn't be a very good parent if I willingly denied my son treatment.

To make matters worse, during a visit here, I was involved in a MVA (as a passenger) and was injured quite badly. I go for therapy twice a week, plus countless appointments with a neurologist.

Now that I have given a brief summary, here's my predicament. Neither my son, nor I, have a current visa. My youngest son is fine, because he is already a citizen of the US. Is there anyway I can apply for myself and my son to remain in the US given these circumstances? My fiancé and I plan to get married eventually, but have put it off because we want to do everything legally. We have been engaged for four years, and would really like to be able to get on with our lives without living in fear of something going terribly wrong.

I sincerely appreciate any guidence you may be able to give.

Without a job offer from a US employer who is willing to sponsor you for a work visa, the only way you can stay in the US permanently is to get married to your fiance and to have him sponsor you for permanent residence in the US. Your son would naturally be included in that petition.
