My ex-girlfriend has been stationed at Fort Lewis since 1999, but has been on inactive status for the past two years to get a Master's Degree. She will be graduating this spring, and probably requesting to be transferred overseas to Germany as she is dating someone stationed there. We have an eight year old daughter who resides with her. She also has sole custody, but I do have regular visitation with her. We do not get along at all, and she has gone out of her way to cause problems for me with protection orders and visitation issues and police intervention of which nothing has really come about from as I can't do anything wrong or I'll lose what little visitation I do have. I know that she is trying to set it up so that she won't have to notify me when she moves or where she moves to.
I have read info about child custody and the military, but it all deals with new enlistees. What about someone who has been in for 8 years? She did have to sign on for the next 4 years to pay off her student loans. I'm not even listed by her as the next legal guardian in line if something were to happen- her parents are. What rights do I have as a civilian in trying to obtain joint custody and/or not letting her take my daughter overseas? I would think that going overseas, it would be required to have someone else have custody either solely or jointly? Any info on this would be greatly appreciated.

My boyfriend of four years has an eight year old daughter from a previous relationship with whom he has regular visitation with per a parenting plan. On top of that, the ex-girlfriend has a protection order against him that started prior to us dating and gets renewed every year . She goes well out of her way to cause trouble for him hoping that he will lose his visitation rights and just go away. She's not exactly fond of me either for being the current girlfriend.
The ex moved to a different area awhile ago, so the child exchange point had to be changed. She bombarded the courts in two different counties with paperwork, the county where she was moving to and the county where the parenting plan was issued from, so of course, there's some confusion- exactly what she wanted. He cannot call her because of protection order so he goes to location specified by county she moved to. Well, she goes to the other location, doesn't even wait an hour or try to call him- instead calls the cops and files Child Abduction charges against ex-boyfriend, myself , his vehicle and my vehicle!
I am furious!! I was not even with him when she did all of this - I was home with a sick child. This is a very serious charge that she just threw out there, because she wanted to cause trouble for the ex. It had absolutely nothing to do with the safety of the child. Can I obtain the information from the police as to what was said and what I can do. She knowingly filed false charges which will be impossible to prove, but there must be something that I can do so this doesn't happen again.
Here are your two posts as different people.
You need an attorney because you/neither of you, understand family law and are making your problems worse.

Obviously for her to have protective orders and sole custody there is a reason.

You will have to look at the current orders to to see what it says about her moving away, but here is the clincher, since she is in the military, even when she transfers to Germany, her residence, remains for legal purposes, her permenant residence, or the state of her last stateside post, eg, Washington. Even if that were not true, there are provisions re moving when there is a history of domestic/family violence. You may still be able to file to modify visitation, but don't think that they will give you her location because of your history of DV. Look into the mirror to see who is the cause of this situation.
