What is the name of your state? MI

Dear Sir Lana,

I am on H1B and want to switch to Company B from company A. Company B is ready for H1B transfer. Does company A has to cancel or do anything with my H1B visa which they filed?

Also, priority date for LCA with Company A is 09/04.....Do I have file new LCA (or PERM) with company B? Does Company A has to cancel my LCA or will it be automatically cancelled once company B applies for it? OR don't have to worry about it?

Last question: Can I start working for company B as soon as the lawyer receives a DHL courier receipt of the delivery of H1B transfer application?

Answer appreciated.

Thanks
AJ

You are confusing two processes: labor certification and H-1B. They are very different and completely separate. Priority date is not a factor in H-1B processing, so I am not sure to what priority date you are referring, and LCA is not a labor certification but a labor condition application, which is part of the H-1B process but has nothing to do with priority dates. Please clarify.

Please let me know if you have any additional questions or if I may be of further assistance to you in this matter.
