What is the name of your state? new jersey
My husband has been paying alimony to his ex for 5 years and is getting ready to retire. Once retired he is required to give her notice a month after retirement that he has retired. His health is not good ..had kidney removed..kidney cancer..For health reasons we want to move to a climate better for both our health. With retirement alimony stops but she can get a percent of his pension. All he is required to do is notify her that he has retired .How easy will it be for her to acquire pension monies if we are out of state and what are the legal ramifications?

It depends upon the verbage in the divorce decree. If it does grant her part of his pension, she is entitled to it. He must pay alimony in accordance with the terms of the decree, whatever those state. But he could go back and request a modification due to his poor health. It will be up to a judge.
