My husbands daughter had our grandson at age 15. She is now in jail for possetion of meth. We think she should be out by the end of this month. In the meanwhile we took court doc's yesterday for temp guardianship. The father will be incarcerated for a couple of years.stepgmom said:What is the name of your state? California
Without a valid court order, yes, the child is hers and she can do as she wishes.stepgmom said:My husbands daughter had our grandson at age 15. She is now in jail for possetion of meth. She has no education, no job, no housing or means of support.
My question is: If she gets out of jail before the judge signs the temp guardian doc's, will she be able to take him from us? If so, would it be illegal of us to hide him until the judge signs the docs?
Please help.
In addition, the fact that you have filed for guardianship doesn't mean that the judge is going to award it to you without full "due process"...or even that the judge is going to award it to you at all. Therefore you aren't just waiting for the judge to sign the papers...it doesn't work that way.BelizeBreeze said:Without a valid court order, yes, the child is hers and she can do as she wishes.
The answer to your second question can be given in one word: Kidnapping.
Neither you nor your husband have legal rights to the child. PERIOD.

Way to go, Mom! You did a fine job raising her, and passing down those "trailer values"! I guess it's true, "you can take the girl out of the trailer, but you can't take the trailer trash out of the girl."

stepgmom said:Okay, you judgemental ass!! For your information (since you are so damn smart and you got the clue of stepgmom, and the fact I said (my husbands daughter), for your information my children are 26, 21, and 10. My oldest has a masters in accounting and is currently a CPA, my 21 year old has worked her hinny off since age 17 and is a college graduate, my 10 year old wins awards in horse shows. Don't you freakin tell me I'm not a good parent, I don't give a hoot who you are.
I came to the website to get help for a situation I know nothing about, not to be judged by a freak of a lawyer like you.
IAAL, we have family friends (kids younger than us by about 10 years). 3 kids. Mom is an attorney and dad is a retired engineer (who now acts as mom's legal secretary..lol). Their oldest is a hardworking professional with a family, their youngest is a hardworking professional with a family and their middle child has been in and out of prision, badly abuses drugs and they finally gave up on him when he was 28. How do you reconcile that kind of family within your theories?I AM ALWAYS LIABLE said:My response:
Apologies to you. Please replace the "female gender" of my responses with that of your husband. I tip my hat to him! What a guy!
But wait . . . you married that lout! What a great choice. A man who brings children into the world, and lets them go to hell! Wow, what a guy!
Oh, and as for being judged . . . well, when you married that idiot with a recalcitrant daughter, what did you expect people to do; compliment you on your fine choice of partner?
Duhhhhhhhh!

And I'm nutbaggy? What the hell were YOU thinkin' when you said, "I do"?"She is now in jail for possetion of meth. We think she should be out by the end of this month.
