Hi,
I am working in a higher educational college and sponsered by the school. Recently, I found a job in a private comapany. I figured out that I cannot just transfer my current H-1B to this new company. I have to re-apply my H-1B after April 1st and it will be issued on Oct 1st. I really don't want to give up this new job. It's so hard to find a job and want to sponsered you. However, no company will wait for me until Oct 1st. Does anyone have any advice how to fix my situation? Can I start working after I filed my H-1B application or I have to wait until Oct 1st?

Does anyone think I can apply for H1B part-time visa first and then work as full-time after Oct.1st. Anyone has this part-time info.?

No, unfortunately, there is no way to "fix" your situation since you are going from a cap-exempt employer to a non cap-exempt employer and you cannot file that application until after April 1 with a start date of no sooner than October 1. Even if you go parttime, it still can be no sooner than October 1

thank you for your advice.

I would like to know if I can convice my new employee to wait for me until Oct 1st. and still keep working on my current school job, will my current H1B become invalid during the new H1B application process?

One more question, What if my new employee change their mind before OCt 1. and cancel the sponsership, Can I still keep my current H1B valid?
