Our condominium heating gas is submetered.
We have approximately 7 units (22%) that get a zero reading on their submeters even though their units are receiving heat. Their actual usage is divided up among the metered readings of the other owners by a rate calculation based on the percentage of the cost. The tenants with meter readings greater than zero pay for the gas heat for those with a zero meter reading.
2 years ago we took a vote of the owners to change to a calculation based on the exact cost divided by the percentage of ownership for each unit for gas.
Because of the 66 2/3 majority requirement to pass this failed. Some owners did not vote which counted as a vote against the change. Most of those with a zero reading voted against the change.
Those who get a zero reading are not interested in paying other than what they are billed.
And they are billed according to whatever the meter says. We have no automatic calculation,
if the reading is zero, to compensate for it.
Last April the board voted down the approval of a $100 repair for each broken meter.
Some owners zone valves or other connections within their units are malfunctioning. We were told that we have no legal right to enter their units to repair them.
Our board president told us that we cannot backbill for gas heat.
We have a 7 member volunteer board, which elects its officers. The owners re-elect the same board members who vote this way.
What avenue does the honest owner have to obtain justice? Is there a simple solution?
