What is the name of your state?

My cousin was arrested in a park with the charge of posession of Merijuana over 2 ounces and he was a moron and showed the Police officer a false ID and got charged with failure to Identify. He has hired a lawyer.

What punsihment is he looking at, he is a first time offender?

You are going to get a lot of smart ass replies on here, the best policy is to just ignore them and they won't get to have their fun with you.

It is really important to find out if they have him on less or more than 2oz as that is the breaking point. It is either a misdemeanor with a max penalty of 180 days / $2000 fine, or a misdemeanor with max penalty of 1 year / $4000 fine.

The best part about our great State of Texas is that with no prior felony convictions, if convicted of possession of less than one pound of marijuana a judge must impose a sentence of probation with mandatory drug treatment. If no treatment center exists within the jurisdiction, the judge may waive the treatment requirement. They judge can also waive all fines.

So if you plead poverty with the public defender (this is assuming you can't beat their charge - you may want to review the search and evidence with a private attorney first) the judge will probably waive all fines in exchange for taking some classes and pissing in a cup at their beck and call for a year.

Don't sweat it. They'll dismiss the BS ID charge if he pleads to the drug charge and does the treatment.
