My husband and I built a house a year ago. We signed a driveway maintenance agreement with our neighbors, who have not built their house and don't intend to for some time. Our deed restrictions state that we have to pave our driveway within a certain time. We have not paved ours yet because we know it will be destroyed when the neighbors decide to build. Yesterday we got a letter from the head of our association telling us we have until July to pave our driveway, which is fine. However when we called to ask if he sent the same letter to our neighbors who we share an agreement with, he told us no and that we are responsible for installing the driveway.

After looking at our driveway agreement, nowhere does it say who is responsible for the original installment. It only refers to maintainence and repairs. Does anyone know if we have a leg to stand on if we try to get the neighbors to pay for 1/2 of the install?
