What is the name of your state? Oklahoma My father in-law is trying to apply for social security benefits and plans to retire next year, his last name is misspelled on his birth certificate but not on his SS card and the SS office is saying he is going to have to go to court and have his name changed on his birth certificate? Can anyone offer any advice?

What kind of misspelling are we looking at? Is it Jon instead of John? Or is it Jon instead of Peter?
In order to correct his Birth record, he can apply directly to the Vital Statistics office servicing the town he was born in. They will guide you as to the evidence he will need to correct his birth certificate.
