What is the name of your state? Ca

I have been married for 7 years and probably going to divorce my wife, how can they prove my income I make $8 an hour and show check stubs every 2 weeks of 250 to 300 thats 600 a month, but I make close to 4,500 a month how is her lawyer going to prove it for her alimoney? I know that it's after 10 years you are screwd to pay till she gets married but wondering how much will I have to pay if I divorced her before 10 years?

P.S I am a bartender and it's all or most as you can see Cash income!

Listen up I am not asking how to get away with murder, and I am not trying to get out of paying my child support which I am ready to give more then any judge would ask for! I just don't know how they are going to prove my income, and guess what either do you so instead of being a smart azz just say you dont know law and shut the hell up ;)

That was an attorney you just accused of not knowing the law :rolleyes: You are asking for advice on how to cheat. Nobody here is going to help you with that.

paying alimony question

My guess is going to be the courts will look at your tax return, since your wages include tips that you earn.
Everyone knows waiters and bartenders earn tips that are part of your wage, so you're going to have to show them that yes- you may make only a small amount in yuor hourly wage, but that you get tips on top of that.

I hope that helps, and ignore the dope who said you're trying to pull something. Because it sounds like a legit question, not that you're trying to get away with anything.

It's nice to get some facts every once in a while!!!!

If your stbx wife engages a good attorney he or she will probably suggest the services of someone like a "vocational specialist" whose job is to determine the range of salary/tips a bartender can make in your area of California. It's not just for alimony purposes, which may or may not be granted, but for child support.

As far a child support, I already said to my wife my angel has nothng to worry about I am no deadbeat and will allways support her!

My tax returns show I made an average of 35,000 a year the last 5 years...

So are you also expecting that your CS obligation will be calculated on your income minus cash earnings? As for your wife being represented..... a case could be made for you to be responsible for her legal fees. :D And if you by chance do NOT report your tips, etc on your tax return - expect a call from your friendly IRS representative.

(edit) I'd also expect, if your wife is the least bit smart about it, that she has records of your financials over the past 7 years, which will likely indicate a higher income than you're now claiming.

Let me make it very simple.... so that this idiot can follow....
1) Your wife will report your income to her attorney.
2) Your wife will provide (or her attorney will get, subpoena if needed) copies of ALL of your bank records.
3) And unless you have been burying your cash in mayonaise jars in your backyard, the attorney will be able to see what you have spent your money on (car, boat, motorcycle, stocks, whatever...) and see that you are clearly spending beyond your 'reported income'.
4) Finally, when all of this is done.... with any luck, the IRS will come a 'knockin' and look for their share of your unreported income.

So, have fun while you can. Your own mouth.... and spending habits, will very likely fry your ass!! :D

I would imagine that so long as you've reported your "cash" tips on your income tax return - you have not been hiding income as everyone is saying.
The court system (and your lawyer) will have you fill out a financial statement and a statement of net worth. This includes your income and your assets (401K, etc) AND your expenses, health and all other are included.
Fill it out honestly and accurately and you will nto get yourself into any hot water!!!!
If you show you have nothing to hide up front, a lot of digging (probably) won't be done - unless your stbx insists that there is $ you're hiding.

In his first post he said that he made an average of 4500.00 a month.

12 X 4500 is 54000 per year.

He stated in a later post that his tax returns show an average income of 35,000 per year.

If he was wise he would settle the case for whatever the guidelines indicate would be appropriate for 54,000 a year....including alimony. That is about the only way he can guarantee that the IRS won't end up knocking on his door.

As far as for JETX, someone mentioned you are supposedly a lawyer and if thats the case you should be the last person taking about cheating or trying to screw anyone. Everyone knows on these message boards how Lawyers can screw and cheat ;) How dare you TYPE with that type of attitude. I will say that it's cool of you to be on these boards giving advice, and i hope the right advice, but then I was thinking I hope he is retired cause if he has this much time to be on these boards, how good of a lawyer could he be giving anyone advice! ;)

And if you are retired and have nothing else to do, good for you and wish only the very best to ya! Nothing but love ;)
