If one spouce moves out from the home and the other stays and pays the entire mortgage for a few years, while the divorce court case is going on, is the spouse that moved out required to pay half the mortgage (or credit towards a payoff) for the other party? I'm hearing conflicting stories, that the one paying is paying with comunity money so no credit is due. And Ive heard that there will be a credit for half of the mortgage payment. Which is correct?

I am not sure that there is a flat answer to that question. I think its probably something that is decided on a case by case basis, based on the overall facts of the situation.
