Child Support overpaid and kept by State

What is the name of your state?What is the name of your state?Oregon. My husband owed back child support in the amount of 2555.00. Our Fed refund was taken and more money was taken when we refinanced our home (both totaling over 5400.00). The child support was paid to the ex-wife and a check was sent back to us. There is still over 1200.00 that Support Enforcement is keeping -- they say they can keep it for 6 months!! Can we charge interest, demand they sent the 1200.00 to us, ANYTHING???

They are keeping it to make sure that he doesn't go right back into arrearages. If he pays his child support faithfully then he will get it back.

If his payments are current , file for a CS modification and get an order directing them to return the overpayment forthwith the order .

Once you have the court order in hand send a copy to the enforcement unit .
