yes we both use it. the deed says to share maintinance when needed. He just put another house on his property ,all of the big trucks tore the drive up.now he wants us to help pay to pave the drive which would include repairing the damage he did.If he had not built the house it would have been just fine. live in missouri

Tell him he is overburdening the easement and you are not liable for any disasters he caused.

You are only required to do normal maintenance. This is not normal.
