We purchased our home three years ago as part of an estate sale. The elderly man who lived here had a carport build onto the back of the home and had used it for many years before passing away. County records show our home was taxed on this carport, that could only be reached by use of said easement, since end of year 1995. There was no permit taken out to construct the carport, so no exact date can be given. The original easement was not given for this property's use, but for a property behind this one, and there is a road maintenance agreement in place for those two property owners. WE have paid for gravel for the easement twice since we bought the home.
The neighbor who gave easement to the property behind his has decided, since our for sale sign went up, that he would fence on the property line to "re-claim his property" (the easement), thereby cutting off ingress & egress to the carport on our property, but stated he would leave an opening in the fence until we have moved completely out.
Do we have any legal recourse?
