I own a business. We hired an employee for a simple receptionist job and explained to her that she was on a 90 day probation period. At the end of the period she would be evaluated. After her evaluation we came to the conclusion that she was not working out. She had been written up on numerous occasions mostly for making personal phone calls. When my office manager filled out her seperation papers she checked lack of work to try and help her out with her next job instead of checking fired. Now she has filed for unemployment. What would be the best way to handle this? She really should have just been fired instead of layed off. Also, was she even with our company long enough to file on our account or would it come from her previous employer? Please advise.

Of course she applied for unemployment. Why wouldn't she?

The question is whether you're stuck with the UC claim now that you've told them she was laid off rather than that she was fired for misconduct. You need to contact your local UC office and see if you can amend or change your initial response and now raise an eligibility issue.
