My wife is trying to apply for a new job in FL. The interviewing HR talked w/the previous supervisor and was told that my wife was having issues with attendance. My wife explained the issues that were causing the attendance problem to the new HR. My question is can her previous supervisor give out this info, and is it a legal practice in this state? Thanx Kory :confused:

Yes and yes.

An employer may give out any information on a former employee that is either true or represents their honest opinion. If your wife had attendance problems at her previous job it is perfectly legal for her former employer to say so. She is free to explain the reasons behind it but the employer violated no laws in providing the information.

The widespread belief that an employer may legally only give out dates of employment, salary, job title and rehire eligibility is completely erroneous.
