Injury from Tripping over Manhole Cover

My 75 year old dad tripped over a manhole cover in the middle of a residential street and injured his leg. The manhole cover was not level with the street, it rose almost 2 inches above street level.

After falling, he was immediatly taken to the hospital to receive medical treatment. His leg is not broken, but extremely sore. There were also witnesses to the incident who helped him.

Is the city liable for this? If so, what steps should be taken to receive compensation, if any.

Why was your dad walking in the middle of the street and how long has that manhole cover been that way?

Was sidewalks availible - is this a normal crosswalk? He would be lucky to have his injuries paid for by the city and it is doubtfull that he will receive any more.

Simple answer is no, the city is NOT responsible. Your father is. Next time, tell him to pick his feet up or go around the visible hazard.
