Good morning! We live in East Texas on 30 acres outside a city limits, in the country. WE bought the land in 1999 and built our home here in 2002. We are going to put cattle out here and have to work on some fences. I have searched everywhere on the web for some info on this but can't seem to find any. On the back side of our place we have already put our end posts and posts up ready for wire. We have one place back there for a gate in case the cows were to escape we would have a way to get them back in. Our place back there adjoins another person's property that is unused pasture land and woods. We received a certified letter from this person saying that he would not give permission for a gate to go back there. I guess he was out and assumed that was what it was going to be. Anyway, my question is, doesn't there have to be a gate access when you run cattle on a place in case they got out and you needed to get them back in? We don't want access to this person's property, but we think that is what he is worried about. Anyone have any ideas?

So long as the gate is on your property and stays closed, how does it affect your neighbor?

It sounds like your neighbor doesn't want you accessing your property from his property. Perhaps you should talk to him and find out what his problem really is.

Follow up your conversation with your own certified letter stating that the gate will be put up, but that you understand that you do not have permission to access his property.

I would also believe that a gate ON YOUR PROPERTY, even if it would allow access to his property is well within your legal rights. That would be tantamount to him saying that he will not allow you to put up barb wire. It is your fence on your property. The only thing he could do is go after you if you used to gate to go onto his property without his permission.

While there is no statute which requires or forbids you from placing a gate in a fence or fence line, there is also no statute which requires you to place the gate in a particular spot.

The neighbor has legitimate concerns and although you have the right to put a gate wherever you wish as long as both the fence and gate are clearly on your property, the better solution would be to relocate the gate.
