my boyfriend and i are getting married in july and building a house,he was married a few years ago and they had a home together and sold it after filing for divorce and split the money...he then bought a townhome (where we live now)the divorce was final ten days after so they had to put a married man on the title,she NEVER lived there never even walked through the door and now will not sign a quit claim so we can sell...she says she wants money from it...what nerve! :eek: they had already sold there home and had a divorce aggreement but she is angry because he is suing her (she wanted the car in the divorce and was ordered to remove his name and she didnt and then turned it in! his lawyer filed for a emergancy hearing because we HAVE to sell fast because of our other loan we are closing on...is there anything we can do? :mad: :mad:

He should NOT have closed on a purchase prior to divorce finalization unless he had a quit claim of any potential interest from her. That is the ONLY way a still-married person completing a divorce should close on RE. Did he discuss this plan with his divorce attorney before going ahead?

No, there is no automatic fix to this title issue. That is why RE purchases should be done properly when one is taking or tranfering title, because there are long-term implications to what one does.

You could offer to buy out her interest, if you want this settled pronto..

we were told in florida it is legal to own property without your spouse,her name is not on the deed or title they had to put a married man on the deed because he was still married....
