I live in Va. I had two older dead trees fall on a neighbors fence and into his back yard. I am not covered with my homeowners insurance. My adjuster told me to have the injured pary call his insurance company. Am I off the hook?

Yes and no. If the trees were old and rotting and you could have known this fact, be prepared for the insurance company to come after you.

**A: of course not. Have you removed the trees and made firewood?

You are responsible because you knew the trees were dead so your insurance company will not cover you. Are you in a Condo, does the HOA cover maintenance of landscaping or is this in your private yard?

More detail might help. I have a large lot, 3/4 an acre. The back 1/2 acre is wooded and we never really go there. These trees fell on the back of the property. So I guess the point is, I had no idea the condition of these trees.
