Easement--township storm drain system

Our township has a 7.5 feet wide public utility easement at the rear of our property for the swale, and for the storm drain system. (Actually, the town's easement is 15 feet wide down the entire block--7.5 feet wide at the rear of each property of each homeowner.) There is a storm drain system for the entire block that ends at the beginning of our property. That is one problem, because the water basin is in the wrong spot--it's elevated too high for our property and two other properties adjacent to ours. Therefore, the three properties (including mine) have recently started severe flooding--so much so that our young daughter occasionally cannot play in our backyard for two or more weeks at a time.

Since the township has an easement, and the storm drain is not in the correct spot and therefore causing (or at least helping to increase) the flooding, is it our township's responsibility to pay for the work to be done to make the correction? (Whether it be adding dirt, grading it properly, adding a new drain and/or tying into the old, existing water basin/storm water drain?

Please help! This is also a health hazard for my family--especially our young daughter!
