We live in a small horse property neighborhood of 58 houses. This is a new neighborhood with a new board of directors for our HOA.
Our neighbor violated the CC & R's by blocking the easement drainage ditch that runs through both of our front yards. Now, whenever it rains, our front yard floods. This has ruined 3/4 of the landscaping in our front yard. We first went to the neighbor and asked him to put pipes in under his driveways, we even offered to help him do it, but he refused.
We have sent numerous letters to the HOA asking them to enforce the CC & R's and have the neighbor put pipes under the driveways/dirt that they blocked the ditch with. Its been five months and so far the HOA has done "nothing". The CC & R's clearly state that a homeowner may not change the flow of drainage or block the flow of water through the easement draingage ditch. If the HOA continues to ignore our pleas and if the neighbor continues to refuse to put in pipes to restore the flow of drainage, do we have any legal recourse?
