Possible false appraisal

I received a market appraisal from an experienced, well-known broker for use in a divorce settlement. I was bought out of my home from my ex and was assured by my ex that the house would not be sold. verbal, of course. Now, 6 mos. later my ex listed the house with the same broker who gave the market appraisal and the listing price is over 40% more than the appraisal. :mad: The listing price of the home doesn't surprise me but the appraisal I thought at the time sounded too low - but I was not in a position to argue. If I can't sue my ex for the profit loss, can I sue the broker for the crappy appraisal? Note, it was not a paid appraisal, but the broker did submit an official appraisal to be used in the settlement agreement. Thanks!
