Is the Homeowners Assoc. Responsible?

The backyard of our property hosts a water retention pond that the Township says must maintain a certain volume. Our backyard slopes at a 1:1 slope down into the pond. Within the last year we have lost about 5 feet of backyard due to settling and sliding of this slope. The Township has evaluated the drainage system and says it is working correct and the Homeowners Assoc. is responsible for maintaining the pond and bordering easement. We have had it evaluated by two companies and 1) the slope cannot be regraded, as it will decrease the pond volume 2) the pond cannot be moved back as it invades the easement and preserved land that must be maintained. They both recommend retaining walls. Is this cost the responsibility of the Homeowners Association? What rights do we have to "get back" our lost yard and keep the yard from continuing to erode?
