We have a 15 ft egress/ingress on an adjacent property. We went to get a culvert permit and found out that the road is a state highway, not county. The state highway department said they would not give a culvert permit without adjacent property owners signature. Property owners are not willing to sign anything. What are our rights?
To make it more complicated, found out that highway dept requires 5 ft from property line, 12 ft incline culvert, culvert footage, then another additional 12 decline culvert. We know we do not have 40 ft of easement; however, we went to adjacent property owners and they want to install a combined culvert. (Reduces amount of culvert in front of adjacent property to 24 ft. This culvert would be on state property) Highway dept still would not issue permit without adjacent property owners signature. I do not understand. Can anyone help?
