FIL passed away and will left only daughter as sole beneifcary. Stepmother of 7 years has renounced will.
FIL primary residence was deeded" Joint Tenants" no metion of " With Rights of Suvivorship" with stepmother. Both names are on all the mortgage doc's. Balance remaining on mortgage , but we have been told she has gone to bank and said she can not afford the mortgage. The bank has filed a claim against the estate for the remaining mortgage.
My question is with the deed. Since no metion of WROS do we have a claim to be partial owners of the house? If not, who is responsible for mortgage( estates attorney said she is responsible)?
