October 27, 2004 L.A. City amended LAMC 42.15 prohibiting participation in the Free Speech Zone on Venice Boardwalk without a permit. A lottery was set up to allocate designated spaces to permitees.

March 1, 2005 the new program began and only people who bought a permit and entered the lottery could legally set up. Our group sees this as an infringement of our 1st Amendment Right to free speech and our group has not joined the permit/lottery program.

We need help to file a Tort Claim against L.A.City and the LAPD for (a) violation of First Amendment Rights (b) discriminatination and harrassment (we have been targeted by LAPD).

Any suggestions?

Contact the ACLU or other like minded organization that likes to do pro bono work in civil rights cases. If the ACLU is not interested in taking your case, perhaps they don't think that the law is on your side.

No one is infringing your right to free speech.

The city is controlling access to a certain part of the city.

You would lose any case brought and the ACLU will NOT take such a nothing case.
